1. Baker: 'Last Night’s Hearing Did Not Go As We Hoped'

“In a letter sent to membership on Friday afternoon, Charlie Baker stated Thursday’s House v. NCAA settlement hearing “did not go as we hoped.”
For more than two hours on Thursday, plaintiffs’ attorneys, the NCAA’s attorney and objectors met with Judge Claudia Wilken on a Zoom call. The date had been circled on calendars by college sports administrators for weeks.
Wilken did not give preliminary approval, pushing back on the language centered around third-party NIL restrictions in the settlement. She expressed concern that the agreement would take away from the “large sums” of dollars currently going to athletes.”
» What’s Next. “The NCAA and plaintiffs’ attorneys now have three weeks to craft new language around NIL collective restrictions. At one point, the NCAA’s attorney, Rakesh Kilaru, called the disagreement a possible dealbreaker.”
» Worth Noting. Plaintiffs’ attorneys Jeffrey Kessler and Steve Berman are fine moving forward with or without a settlement. Kessler told the judge Thursday he was happy to schedule a trial date.
» What They’re Saying. “Either we’re moving forward with a deal or not. We’re happy to make the changes the judge suggested in NIL. I hope they’re willing to do it, too. But if not, we’re not going to spend the next three or four months negotiating.”

2. Juniata Breaks DIII Consecutive Victory Mark
“The Juniata women's volleyball team has had the same lede for 67 game recaps as they defeated Swarthmore 3-0 (25-11, 25-14, 25-15), thus breaking the record for consecutive wins in Division III women's volleyball with their 67th straight victory.
It is the third longest streak across all of women's collegiate volleyball as Concordia St Paul (Division II) is second all-time at 75 (2008-2010), and Penn State is number one at 109 (2007-2010).
Juniata returns to action next Friday in hostile territory as they will take on #2 Hope, the team they upended in the National Championship last year, in Holland, Michigan.”

3. WashU Loses CCIW Associate Membership

“The College Conference of Illinois and Wisconsin (CCIW) has revoked the Washington University football team’s associate membership, a CCIW spokesman confirmed to Student Life Friday, Sep. 6. WashU will remain an associate member of the conference until the 2025 season concludes. The news was first reported by d3sports.com.
“The CCIW Council of Presidents have been closely watching the conference membership shifts throughout D-III. It is in the best interest of our core members to be in a position to act quickly if the opportunity presents itself to add a core member that sponsors football,” CCIW Executive Director Maureen Harty shared in a written statement. “We made the decision to give WashU notice now, so they can begin to pursue other options. WashU and Coach [Aaron] Keen have been a great partner and we look forward to their next two seasons in the CCIW.”
WashU Athletic Director Anthony Azama declined to comment.”
» Worth Noting. “Per the CCIW’s constitution, five of the conference’s nine core members can vote to oust an associate member from the conference. It is unclear which CCIW core members voted to remove WashU. “
» What’s Next “It is unclear which conference the Bears will join next. Though the UAA doesn’t currently sponsor football, five of its teams have football programs. However, five schools is not enough for the UAA to receive an automatic bid to the NCAA tournament.”

Defending national runner-up North Central remains atop the D3football.com rankings this week. The Cardinals received 17 of a possible 25 first-place ballots to outpoint Cortland for the top spot.
